Slaves were considered property. The federal government had no right, Taney said, to restrict where slave owners could take their slaves. Regarding the question of Dred’s right to freedom because he had lived in the free state of Illinois, Taney said no. He said that Illinois laws did not apply in Missouri. Once Dred returned to Missouri, he became a slave again under Missouri law. Taney went on to say that African Americans were “beings of an inferior order . . ” Taney returned the case to the circuit court.
